Response To Fatwa: Covering The Face Or Niqab From Sister Madinah Aziz To Sister Dr Murshidah in Mangalore, India

Maa Shaa Allah la quwwatah, my wife received from Sister Madinah yesterday a copy of response to Fatwa of Sheikh Abu-Abdullah Adelabu and to an article titled:  Confused About Women Covering Their Faces (Using The Veil): Hijab Even If To Be Harmed Because Of That, which featured on EsinIslam couple of weeks ago.  The material was a correspondence between the Student of Sheikh Adelabu  and Sister Dr Murshidah in Mangalore, India Tuesday 1st February 2011.


My wife contacted Sister Madinah to ask for her permission if she could share the knowlege with other people.  Upon Sister Madinah's consent, I am hereby sharing her correspondence with the Indian Muslim female doctor.

 read u r article of veiling the face,some one had asked u a question is it obligatory to cover u r face?
1.there is no exact hadhis were prophet muhammad (sallalahu alahi wasallam)said the believers that they should and must cover the face,he never made it obligatory.might be there are some hadhis but it never says obligatory.
2.translations some times are not exact impression of arabic small example- most of them tell khimar is face veil, but its a head cover-which has been mentioned during salat(prayer)but when the translate they made it face veil

3.no one in this world has a right to make any thing obligatory when prophet (sallalhu alaihi wasallam) has not made it obligatory.
4.imagine when people go to hajj allah (swt)would have told us to wear face veil ,but it is haram . in islam when its haram one side , how it is obligatory nother side?
i m not against covering u r face, i m against people telling its obligatory.
personally i cover my face but i never tell others who do not cover their face has no strong faith.
allah the most exalted knows the best.
5.covering your face is personnal decision but not obligation.
this act of covering the face will nor gain u any reward nor any punishment.
if u feel u r face is attractive or u wear a make up than do cover u r face.
i tell muslim woman its better not to put on make up when u r going out.
we should never intend to attract others,intention counts. covering u r face if u have a bad intention its of no use.
my message is just dont make any thing obligatiory when prophet muhammad(saw)has not made it
its a request. moreover allah knows the best. follow islam , properly.stop complaining

First let me draw your attention to the opening paragraph of the ruling that says:

The correct view regarding this matter is that it is obligatory for women to cover all of their bodies in front of men".

This is the only context in which the word obligatory was used in the ruling.  Even if this is understood to apply the use of veil (the Niqaab) one should not ignore the phrase "the correct view" [among the scholars], knowing the issue is a contentious one in the Muslim World.

In the article the following verdict was presented to deal with the wrong notion you expressed that there is no Hadiththat the believing women should cover their faces. The command in these two verses is general and applies to all believing women. We pointed out that: Al- Bukhaari narrated that ‘Aa’ishah said: “May Allaah have mercy on the first Muhaajir women. When Allaah revealed the words ‘and to draw their تَحَابَّ »» تَحَيُّن (i.e. their bodies, faces, necks and bosoms)’ they tore their aprons and covered their faces with them.” See also question no. 6991.

In Tafseer of Al-Qurtuubi's Al-Jaami' Li-Ahkaam Ul-Qur'aan, Al-Khumur is Jam' ul-Khimaar with Al-Khimrah as its cognitive nomen verbi of the radical trilateral derivative.  One says: hasanat-ul-khimrah i.e. good veiling or nice veil. See أَح »» إِحْيَان for quinquiliteral verbs Ikhtamara and تَحَابَّ »» تَحَيُّن for Takhammara as defined by Imaam Al-Qurtuubi 's Tafseer. [ومنه إختمرت المرآة وتخمّر] simply to use veil or use niqaab all over Juyoobihinna (i.e. their bodies, faces, necks and bosoms)”.


We also recalled that Abu Dawood (4101) narrated that Umm Salamah said: “When the words ‘to draw their cloaks (veils) all over their bodies’ [al-Ahzaab 33:59] were revealed, the women of the Ansaar went out looking as if there were crows on their heads because of the covering.” Classed as saheeh by al-Albaani in Saheeh Abi Dawood.

The ruling therefore affirmed that the Muhaajir and Ansaari women obeyed this command and covered their faces as clearly stated in the Aathar and Akhbaar.

We wonder what can make people like you commenting on an educative Islamic injunction like this saying to us: "3.no one in this world has a right to make any thing obligatory when prophet (sallalhu alaihi wasallam) has not made it obligatory."

On the authority of Al-Numan bin Basheer, who said : I heared the messenger of Allah say "That which is lawful is plain and that which is unlawful is plain and between the two of them are doubtful matters about which not many people know. Thus he who avoids doubtful matters clears himself in regard to his religion and his honor, but he who falls into doubtful matters falls into that which is unlawful, like the shepherd who pastures around a sanctuary, all but grazing therein. Truly every king has a sanctuary, and truly Allah's sanctuary is His prohibitions. Truly in the body there is a morsel of flesh which, if it be whole, all the body is whole and which, if it be diseased, all of it is diseased. The Prophet (peace and blessings of Allaah be upon him) said: “‘Abd-Allaah ibn ‘Umar (may Allaah be pleased with him) said: A man stood up and said: “O Messenger of Allaah, what clothes do you command us to wear in ihraam?” The Prophet (peace and blessings of Allaah be upon him) said: “Do not wear shirts, pants or any kind of headgear… and women in ihraam should not wear niqaab or gloves.” [Narrated by al-Bukhaari, 1741]  See webpage: She Wore The Burqa’ (Face Veil) In Ihraam Not Knowing It Is Haraam: Should Women Kiss The Black Stone? as another proof that wearing niqaab or gloves was a practice common practices of Muslim women at time of the Prophet (peace and blessings of Allaah be upon him).


The Hadith dismiss the erratic view that “the rest of the Muslim women did not cover their faces” is very incorrect. Rather - as in the article - the command to observe full hijab applied to the wives of the Prophet (peace and blessings of Allaah be upon him) and his daughters and the believing women.

The fact that free mixing is acceptable in Hajj and Umrah ritual cannot serve as an endorsement of free mixing.  Equally, the fact that leaving faces unveiled is acceptable in Hajj and Umrah cannot be understood as an evidence to support not using Niqaab.

Ibn Qudaamah said:

Ibn al-Mundhir said: The fact that wearing the burqa’ (face veil – during ihraam) is makrooh is narrated from Sa’d, Ibn ‘Umar, Ibn ‘Abbaas and ‘Aa’ishah. We do not know of anyone who held a different view. Al-Bukhaari and others narrated that the Prophet (peace and blessings of Allaah be upon him) said: “A woman should not wear niqaab or gloves.” But if she needs to cover her face because men are passing close by her, then she should lower part of her garment from the top of her head over her face. This was narrated from ‘Uthmaan and ‘Aa’ishah, and this was the view of ‘Ata’, Maalik, al-Thawri, al-Shaafa’i, Ishaaq and Muhammad ibn al-Hasan, and we do not know of any opposing view.

This is because of the report narrated from ‘Aa’ishah (may Allaah be pleased with her) who said: “The riders used to pass by us when we were in ihraam with the Messenger of Allaah (peace and blessings of Allaah be upon him). When they drew near, one of us would lower her jilbaab from her head over her face, and when they had passed by we would uncover our faces.” Narrated by Abu Dawood, 1833 and by al-Athram. Al-Mughni, 3/154. The hadeeth of ‘Aa’ishah was classed as saheeh by al-Albaani in Risaalat Jilbaab al-Mra’ah.

In short about Hajj and ‘Umrah, Islam forbids mixing between men and women, so that women will be protected from crowding with men.

It was narrated that Ibn ‘Abbaas (may Allaah be pleased with him) said: The Prophet (peace and blessings of Allaah be upon him) said: “No woman should travel except with a mahram, and no man should enter upon her unless she has a mahram with her.” A man said: “O Messenger of Allaah, I want to go out with the army of such and such and my wife wants to go for Hajj.” He said: “Go for Hajj with her.” Narrated by al-Bukhaari, 1763; Muslim, 1341.

Having said all these, this not the first time we heard people confused about participation of women in Hajj and Umrah as an endorsement for free mixing or and excuse for leaving fundamentals like veil.

It is mustahabb for women to keep far away from the Ka’bah when doing tawaaf, lest they mix with men, even if that keeping away means that they cannot touch the Black Stone.

It was narrated that ‘Ata’ said: The wives of the Prophet (peace and blessings of Allaah be upon him) circumambulated the Ka’bah with the men. It was said to him: “How come they are mixed with the men?’ He said: “They did not mix with the men. ‘Aa’ishah used to do tawaaf far away from the men, not mixing with them.” A woman said: “O Mother of the Believers, let us go and touch the Black Stone!” She said: “Go yourself,” and she refused to go.  

Ibn Jamaa’ah (may Allaah have mercy on him) said: One of the worst evil actions that the ignorant common folk do in tawaaf is when men crowd with their wives whose faces are uncovered, and that may happen at night when they are carrying lit candles in their hands…
